Looks like we're doubling down on the "unique" angle - that being that the majority of clubs promoted to the PL and the 2 sides we came up with all had squads containing PL quality players and had benefitted from parachute payments in the past etc so therefore we (and indeed any future) clubs that are unexpectedly promoted HAVE to spend big to have a hope in hell of staying up so therefore some leeway should be given and that we probably shouldn't have been restricted to the P&L level that we were judged against.... the PL challenged this whole line saying:

"The Commission does question the use of “unique” in Forest’s submissions. It was clear from Mr Brown’s report that 12 other clubs over the last 10 years of the Premier League (so 13including Forest) had been promoted without the benefit of a Parachute Payment the year before. They then joined a league where the other 17 teams all had a Premier League squad and, in the main, would have the benefit of the full £105m PSR Threshold. This is not a unique occurrence, rather it is something that has happened every season in the previous 10 seasons, on average"

What would be Interesting is to test how many stayed up over a prolonged period where they were able to then cumulate the higher spending thresholds

I suspect it may work against them.

I understand that point but the rules are there. You can’t break them and that say you don’t like them. I think the rules are shite, unfair and backward however they are the rules. Everyone’s first thought should be anger with decision makers at Forest not the premier league.
I agree, but it's a mitigating circumstance for some reactions in this thread. LOL
 
It's has potential to antagonize people in authority, and potentially see less things go in our favour as a consequence.
Do you think the great man would have worried one iota about that? Ambition is allowed, I guess he should have said to PT let’s just aim for a finish of 12th in Division one and that will be fine. it is about facts not antagonising people and that’s the facts as the people who run our great club see it. I am fed up of people running our club down and seeing everything as a negative.

Maybe but ironically if the breach was large I’d be less upset. The fact it was a minimal breach seems more like to me that someone has fecked up their counting. That to me is unforgivable.

My take -

1. better than expected points deduction.
2. NFFC response is reasonable - clear message to PL not Commission.
3. Very poor governance at our Club - we knew the rules but didn’t take them seriously enough.
4. we must learn lessons and quickly.
5. we will probably appeal.

We have no excuse and only ourselves to blame if we go down.

If we stay up I worry about our ability to be competitive next season.
Agree LR - except for point 5.

I don't know whether they are or aren't allowed but I can't see them giving Everton another points deduction this season and if they are going to change the way they determine failure of PSR they could push it to the following season and forget it.
If they don’t they’ll break their own rules surely?

The whole reason the financial period was moved was so they could review and punish within the same season. If they deduct points from us but delay Everton’s until next season they’ll look ridiculous.

Yeah you’re right I wouldn’t call £35m a minor breach.

What’s notable to me though is that the £95m we were over would have been totally fine for most other PL clubs despite having three years of premier league income rather than just one. How is that more sustainable 🤪?

Don’t know if this has been said, but why didn’t we just accept the Athletico bid in June. Get that acceptance on record. Then when the deal falls through, almost perfect defence as you could claim you fully tried to cover the losses on time.

We loaned some players. We paid unexpected promotion bonuses. We're told they're not allowable expenses, and allowed a minimal sum for Covid when Everton claim a huge amount. How exactly does this work, and what's fair about it
Now for the covid losses I don't understand the process for determining the loss but it was clear that we presented a figure that if accepted still would have meant a deduction and not worth arguing over as our lawyer who knows more than me didn't use it as a mitigating factor.

We agreed these promotion bonuses. Expecting promotion. I think in the judgement £20mil we asked to be written off. So half what we lost in the champ. A champ team with no players hence we had to spend big last season and end up in this mess. Seems pretty obvious why a commission that aren't forest fans would throw out that argument
 
One thing that is irking me about the 'so much more/worse than Everton' thing is the complete ignorance around how they cooked their books. The COVID losses thing is a f***ing disgrace but it seems everyone is happy to turn a blind eye to it. Crazy, or am I missing something?
£195m loss for covid for them, £5m for us. £105m losses allowed for them £61 for us.

They can cram their whining up their f***ing cram hole.

This is why I couldn't get excited about the draw against Luton at the weekend, our deduction was always going to be enough to put us below them. Had we won the punishment would've been the 8 points requested.

Oh well, we can recover one point. I'm not sure going to war with the PL is wise though, on top of our war with PGMOL.
