There was never a way - it's a three year rolling period. What I hope is good is that they've shown absolutely no attempt to fix things. They reinvested off that Gordon sale when they knew they were in a mess the year before. And the COVID loss thing... They've just tried to get away with it.

Secondly, there is no law against having a dominant position, only against abusing it. You opted not to include an example from the list of abusive mechanisms.

If it's a cumulative punishment then it' ought to be 3 for a breach, and + about 18 for the magnitude of the breach.

I don't see how they can escape with anything less than an 8 point deduction (9 is the nuclear "administration" punishment so the breach punishment can't equal or exceed that)
