I'm pretty sure that if we were going to appeal, it's would have been stated as such by the club by now. Considering the tone of the club statement, it would have been declared in that. They have made their point but I think understand what a fruitless exercise dragging it out will be.

We have been given a lower deduction than the Prem League wanted, our rivals expected and most of us on here predicted.

Should we appeal and go down on goal difference there is no way they are going to change the relegation spots a few weeks later.

Having slept on it, I've retreated from the war zone and am now siding with the 'take medicine and move on' brigade. We need that clarity to draw a line under all this and just get on with the task at hand.
I don't like it - I feel we have been screwed over - but I agree.
We now know exactly what is required - just go out there and do it - no excuses.

I think 20+ years away from the Premier League have diluted a lot of fans views of what top players are. We've clearly got the best talent we've had for 20+ years, but it is still poor by Premier League standards and the squad still ill balanced to be thinking anything near mid table yet.
You make a very good point in my opinion. We probably need at least 3, probably 4 more windows of shrewd permanent recruitment (something Ross Wilson is beginning to deliver in my view) before we can start to look at establishing ourselves - hopefully under Nuno. In the meantime, we need to survive this season, and probably the next two. Hopefully EM and a section of the fanbase will temper their expectations accordingly.

Actually Col you are not, you made the point yesterday and I respect that you have a far greater knowledge than me in that regard. Your comment was taken as fact on that basis, I'm in no not position to question it mate I was surprised though!

When I speak of legal experts I mean those that act as such, as opposed to ones that actually practice it like yourself. Usually the ones that are experts in construction and planning too.

That was my initial thought but a good few people that understand it more than me have said that it is indeed the case.

I thought initially it would be pointless not to appeal but obviously now I'd swallow it and move on.

Well if it's not true the club can sue the Athletic, or at least get a retraction posted.

The initial overshoot was thought to be about 7m, which would match with the 12th place predicted finish.

Unless people would’ve preferred us to play Wayne Hennessy in goal as Henderson’s replacement causing us to get battered every week.

I disagree.

If this is all about financial prudence, then waiting a few weeks to realise £45m rather than £30m is an absolute no-brainer.

Which then means that there's an argument that the spirit of financial prudence was well and truly followed by us.

I know what I'd have done if it was my money.

Pretty sure they're just directly referring to this part of the judgement:

"12.22 The Commission noted that there were few documents that demonstrated what Forest was doing about its PSR issue. There were no board meeting minutes and only a few emails or messages included within disclosure. Most communications were apparently oral. Mr Bonser, the Finance Director at Forest, did produce some forecasts of its PSR position. The first was on 22 August2022, the next was a week later and the next was on 29 September 2022. During this period, Forest was investing in players, so the PSR forecast was changing, but the last of these communications from Mr Bonser was forecasting a significant breach, absent intervention from the Club. These communications did not deter the Club from bringing further players in over the January 2023 transfer window"

Everton's hearing will be held over 3 days next week the 25th/26th/27th March, that suggests their case is more complicated than ours
A Repeat Offence would go down as an aggravating factor, Double Jeopardy IMO wouldn't stick as it is a 3 year rolling period. 3pts the entry point, 2/3 for the breach, Plus 1 for aggravating factor, 1 taken away for early plea like us, so I reckon 5/6 points deducted

As a lurker for a few years before becoming a poster, I am really disappointed how this topic has degenerated into serious but unnecessary personal attacks.

This topic was always bound to have wide-ranging views, initially about the conduct of the Club to put us in this position, then the outcome of the Independent Commission.

My views are simple - I’m very grateful for the financial support of our owner, but I don’t believe in breaking the key financial rules.

I respect others may have differing views.

I loathe what is now happening on the forum - some of the dialogue is dreadful and repetitive. People wanting the last word.

Please can we all behave with respect.

We craved PL for many years, many of us don’t like many aspects of it, BUT
Our focus now needs to be on staying up, and doing our best to support the team.

We will still disagree on team selection or formation, but the biggest issue is STAYING UP.

Woods turned it around now, but his fee s this year anyway. Ayew and Shelvey waste of time. Navas was ok, but very expensive. Danillo was expensive at 17m, Felipe for 2. Was ok and Scarpa for free was a no brainer and we made allot of money on him.

Probably is tbh, they have a figure of 6.9m though.

With regards to Navas I'd have thought we could get similar levels from someone on loan for less wages. Navas did ok, nothing more than that, we did need him, but his wages were astronomical.

Injuries, did screw us allot last year and cost us allot of money.
