Second, at a later time, the Commission will determine whether there has been any further breach of the PSR in respect of: (a) the retrospective capitalisation of £6,561,000in FY21 and FY22 and (b) the capitalisation of interest relating to FY23, as alleged by the PL’s amendment. Accordingly, a further hearing will follow. It therefore remains to be determined whether Everton has exceeded the Upper Loss Threshold by any further amount regarding the interest capitalised in FY21, FY22 and FY23. We accept that this defers the resolution of part of this dispute. The Commission is acutely aware that there are many stakeholders – to name some: the PL, Everton, the Everton fans, all other-8-Premier League clubs, the public – interested in the speedy determination of these disciplinary proceedings. Nevertheless, in fairness to the parties in these proceedings, the Commission decided that the issues which remain cannot be dealt with in accordance with the timetable set out in the Standard Directions. The Standard Directions will not, therefore, apply to the remaining issues.

So we're now effectively saying that the rolling 3 year period means absolutely nothing? The whole thing is a farce, from top to bottom. I wholeheartedly wish that Forest take this as far as possible, past the court of arbitration for sport and into the legal courts.

The disciplinary committee is drawn from 15 independent people . Can't see a published list - but those declaring themselves all seem KC legal types. Then the appeals committee is drawn from a different pool of five people

Think it's other way round. It's the Premier League that are saying Everton undersold the breach but put forward that amendment too late for the commission to take it into account.
Regardless if they did breach by more and deserve a higher punishment the commission has said they won't get any deduction anytime soon.

It was stated in the appeal that Everton 2021/22 calculation was 10m but it is now 3.8m so that is why another commission will be set up

Double punishment? The first one was carried over from last season. You can be sure if Everton had survived a deduction last season, this double punishment wouldn't have been mention on the 2nd charge this season.

So, this means we can smash the transfer market again without worrying about 2 of the 3 years as they won't be taken into account? as can Everton, again?
